On October 16, 2026, the National Association of Wholesaler-Distributors filed a motion for a stay pending appeal in NAW v. Feldon, the federal case in which the court upheld Oregon’s Recycling Modernization Act on August 27, 2026, and attached declarations from three witnesses. As of the free docket's last update, on the morning of October 20, 2026, it showed no ruling on the motion, and the docket text does not say what NAW asks the court to stay.

What this means for you: a motion is not an order. If you were not a NAW member on February 6, 2026, nothing changes, so keep registering, reporting, and paying as before. If you were a member, keep treating continued protection under the February injunction as unsafe to plan around, and talk to counsel before any order issues. Follow the case on the Atlas.
